About Us
Kirschenbaum & Phillips is an independent law
firm established more than 50 years ago with long and deep roots
in the collection industry. We have effectively blended the energy
of a collection agency with the power of a law firm. As a result
we believe that our time tested methods of collection of accounts
to be unique and produce better results than the traditional “collection
agency techniques”. There is no doubt that debtors and their
representatives are more sophisticated than ever which mandates
that creditors and their representatives be on the cutting edge
to remain a step ahead.
We have a long and distinguished roster of satisfied
clients. Our clients consist of lenders, purchasers and servicers
of debt, collection agencies, medical professionals and the general
business community. Many of our clients have been with us for decades
confirming the confidence and trust they have in our abilities.
Before we begin our journey together, we clearly detail our responsibilities
and obligations in a written retainer agreement.
Enlisting the assistance of a law firm in an attempt
to recover assets brings speedier results due to the power and effectiveness
of legal action. Turning to our law firm enables you to have the
same firm represent you in the collection process and in obtaining
an enforceable judgment. The process becomes seamless by avoiding
the delay in moving your account from an agency to a law firm. Placing
your accounts with our law firm sends the message that you are serious
and that you are represented by trained professionals skilled in
negotiating and settling cases.
It makes good sense to aggressively pursue assets
that are rightfully owed. It makes equally good sense to utilize
the power of a law firm knowing your lawyer is licensed and has
the reputation and resources that you can rely upon. Kirschenbaum
& Phillips is such a firm.
Kirschenbaum & Phillips has all the necessary
resources to deliver the results you demand. Since our most valuable
resource is our staff, we have gone the extra mile to ensure their
efficiency and effectiveness. Our staff’s skills are constantly
improving as a result of continuous training on FDCPA, GLB, HIPAA,
relevant federal and state laws and rules, collection techniques
and available resources. Clients will discover the effectiveness
of our employees consisting of attorneys, paralegals, legal secretaries,
clerical and file room personnel, computer operators and a separate
collection department comprised of supervisors, legal collectors
and skip locators devoted entirely to creditors’ rights.
Admitted in all New York State Courts, Federal
District and Circuit Court of Appeals, as well as the U.S. Court
of Claims and the Supreme Court of the United Stated, it is evident
that our attorneys are entrenched in the system. Our collection
department is consistently successful in locating skips, places
of employment, bank accounts and other “hidden” assets.
We are constantly reacting and responding to the
many changes in our industry such as the emergence of debt buyers
and sellers, as well as the effect of FDCPA, FCRA, GLB and HIPAA.
We actively strive to meet the diverse needs of our clients, while
maintaining extraordinary relationships with them and ultimately
delivering the legal representation necessary to meet each clients
needs.
We are completely automated and have an online
IBM Midrange AS-400 Series Computer interfacing with our Windows
2000 file server, driven by a high speed internal PC network. We
can electronically interface with most systems. We have developed
a custom New York Litigation System and we are also active on the
CLS System and You’ve Got Claims. Our state of the art equipment
enhances the speed and efficiency in which we process accounts through
the creative use of modern information processing.
We have complete imaging capability including bar coding for a paperless
law office. The firm has established its own, fully electronic,
proprietary network of co-counsel throughout the United States.
In essence, our services are all-inclusive and
designed to effectuate collection of the claim that is forwarded
to us as promptly and as completely as possible.
